*HOW A FOREIGNER CAN ACQUIRE A REAL PROPERTY IN BULGARIA*
Any foreign person may obtain the right of ownership upon real properties located in Bulgaria. This can happen if the following conditions have been observed:
Acquisition of the right of ownership upon real properties without the corresponding ideal shares of land – this procedure may be finalized by preparing all necessary documents related to the conclusion of the deal, so any foreign citizen /physical entity/ may be a party upon such deal.
Acquisition of the right of ownership upon real properties with the corresponding ideal shares of land, land-plots /either regulated or unregulated/ - in such case any foreigner may conclude the purchase but only as a body corporate and this may happen by registering a corporation /company/ with registered address in the Republic of Bulgaria. There is another option for concluding such types of deals:
After Bulgaria has entered the European Union it became possible for a foreign person to acquire property and enter into possession of ideal shares in a farmland without being obliged to register a corporation /company/. This may happen only if Bulgaria has signed an international treaty with the member-state where the said foreign party comes from.
Without such treaty being signed it is not possible for a foreign body to acquire the right of ownership upon a real property as a physical entity, and in such case the latter shall be registered as a body corporate.
When all necessary documents for the registration of the company have been prepared and subsequently the company has been duly registered in the local District Court, any foreign body may become an owner of land in the country.
